District Attorney’s spokesman Jess Vecchiarelli said the complaint was filed in Lewisboro Town Court in New York on October 19.
Kathleen McCormack Durst was last seen in 1982 and was pronounced legally dead in 2017. His body has not been found.
Durst is battling Covid-19.
Hours before Kathleen McCormack was set to speak to investigators about Durst’s mysterious disappearance, Durst was charged with first-degree murder in 2000 at Berman’s Beverly Hills home.
Her family is “overjoyed” Durst has been charged, attorney Robert Abrams said.
The family will have no further comment until the matter progresses, he said in a statement.

Robert Durst has been charged with second-degree murder in the alleged murder of his ex-wife in Lewisboro, New York, “on or about” January 31, 1982, court documents say.
The one-page complaint alleges that “defendant Robert Durst, at the above time and place, caused the death of Kathleen McCormack Durst, with intent to cause the death of Kathleen McCormack Durst.”
The complaint, filed by a New York State Police investigator, comes from files maintained by the Westchester County District Attorney’s office, the New York State Police, and the Los Angeles District Attorney’s office, as well as “conversations with multiple witnesses and comments from the defendant’s recorded interviews.” and the court’s testimony in the relevant proceedings.”
The Town of Lewisboro Justice Court Clerk’s office provided the complaint, which has been stamped on October 19.
